Terms of Conditions for Missed Call Text Back Feature

1. Introduction

These Terms of Conditions govern your use of the Missed Call Text Back feature ("Feature") provided by ClientSync Marketing Innovations LLC ("Company", "we", "us", "our"). By activating and using the Feature, you ("User", "you") agree to these terms in full. If you disagree with any part of these terms, you must not use this Feature.

2. Feature Description

The Missed Call Text Back Feature automatically sends a predefined text message to callers who are not answered within a specific timeframe. This service is designed to enhance communication efficiency and ensure timely responses to missed calls.

3. Eligibility and Registration

To use the Feature, you must be a registered user of ClientSync Marketing Innovations LLC services and in good standing. You are required to activate the Feature through your ClientSync Marketing Innovations LLC account settings and may be asked to configure settings or preferences related to the use of the Feature.

4. Usage Restrictions

You agree to use the Feature only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Feature. Prohibited activities include but are not limited to:

-Sending harassing, abusive, or threatening messages.

-Transmitting obscene or sexually explicit content.

-Engaging in fraudulent or deceptive practices.

-Violating the privacy or intellectual property rights of others.

5. Charges and Fees

The use of the Feature may be subject to additional charges and fees. These fees will be disclosed to you at the time of activation or modification of the Feature settings. It is your responsibility to review and understand these charges before using the Feature.

6. Data Privacy and Security

We are committed to protecting your privacy and securing the personal information you provide to us. The use of the Feature will be in accordance with our Privacy Policy, which details how we collect, use, and protect your information.

7. A2P 10DLC Compliance

In compliance with A2P 10DLC regulations for messaging in the United States, you acknowledge and agree to adhere to all applicable laws and carrier requirements related to the use of 10-digit long codes for application-to-person messaging. This includes, but is not limited to:

-Obtain any necessary consents from message recipients.

-Ensuring messages sent via the Feature are not misleading or harmful.

-Complying with carrier standards and messaging throughput limitations.

-Adhering to opt-out mechanisms and respecting recipient preferences.

Failure to comply with A2P 10DLC regulations may result in penalties, including but not limited to suspension of the Feature, fines, or legal action.

8. Modifications to the Feature

We reserve the right to modify or discontinue the Feature, temporarily or permanently, with or without notice to you. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Feature.

9. Termination

Your right to use the Feature may be terminated if you violate these Terms or engage in any activity that may harm ClientSync Marketing Innovations LLC or its users. We reserve the right to terminate or suspend your access to the Feature with or without notice.

10. Limitation of Liability

The Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use or inability to use the Feature.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of State of Hawaii, without regard to its conflict of law provisions.
